Democratic development and the rule of law in the context of international integration

a legal perspective

Resumo

This article examines the development of socialist democracy in Vietnam through the lens of legal theory and constitutional practice within the broader context of international integration. It aims to clarify the legal foundations of democratic governance and propose solutions to enhance the effectiveness of the rule of law and people’s sovereignty. The study adopts a legal–institutional and multidisciplinary approach, combining the analysis of Party documents, constitutional texts, statutory frameworks, and implementation reports with dialectical reasoning, historical-concrete methods, and comparative legal analysis. Findings indicate that Vietnam’s democratic development has increasingly been institutionalized through legal mechanisms that protect citizens’ rights and reinforce accountability. However, limitations persist, including formalism in implementation, weak enforcement mechanisms, and inconsistencies in the legal framework. Advancing democracy in Vietnam requires deepening the legal basis of socialist democracy, ensuring that all state power genuinely belongs to the people, and aligning domestic law with international legal standards. Strengthening legal consciousness, refining legislative quality, and enhancing judicial independence are essential to realize the dual goal of democracy and the rule of law in the era of global integration.
