A (im)possibilidade de inclusão do abandono afetivo como uma hipótese de deserdação no ordenamento jurídico brasileiro

The main objective of this research is to verify the possibility of including emotional abandonment as a hypothesis of disinheritance in the scope of the Brazilian legal system, especially due to the importance of affectivity within family relationships. This time, the problem that we intend to answer in this article is the following: considering the relevance of affectivity in the context of Brazilian families, is it possible to include emotional abandonment as a hypothesis of disinheritance in the Brazilian legal system? Thus, in the first item of the work, brief notes will be made about family law in Brazil and the principle of affectivity. Next, the article will deal witth the Law of Succession and the forms of exclusion of heirs for indignity and disinheritance. Finally, the possibility of including emotional abandonment as a hypotesis of heir through disinheritance will be investigated. It was concluded, with the research, that it is possible to include emotional abandonment as a cause of disinheritance, so that today there is even a bill in the National Congress regarding the matter. However, it is highlighted that the ideal would be to include affective abandonment as a hypothesis of indignity, since, thus, its practical effectiveness would be greater. Finally, it is highlighted that the deductive approach method will be used. Regarding the method of procedure, the monograph will be used. Regarding the research technique, this will used the bibliographic technique.
