The overcoming of Trade Union unicity and the challenges of Trade Union plurality by the freedom of Trade Union association recommended by the International Labor Organizatioa

The present work analyzes the damages caused by the choice and maintenance of the model of the trade union unicity, as a result of its incompatibility with the democratic precepts and the freedom of Trade Union association recommended by the International Labor Organization. It was due to the coexistence, for more than 30 years, of these antagonistic precepts, that Brazil succumbed in an accentuated crisis in the union movement, sculpted in the fall of the rates of unionized workers, even in the face of the growing number of occupations and increase in the number of trade unions. The proposal of this work, as an answer to the problems faced by the brazilian trade union structure, is the adoption of the model of Trade Unions plurality. To this end, the peculiarities of each model, Trade Union unicity, Trade Union plurality and Trade Union unity, were analyzed, as well as their compatibility with the precepts of freedom of Trade Union association. Finally, it was concluded that the Trade Union plurality, even presenting several challenges for its implementation, is the effective mechanism to re-democratize the unionism in Brazil, besides guaranteeing, in a genuine way, the freedom of Trade Union association.
