FREE INITIATIVE AND RESPECT FOR PRIVATE PROPERTY: A STUDY ON THE SOCIAL FUNCTION AND SANCTIONS FOR VIOLATION OF THE BRAZILIAN ECONOMIC ORDER

The study is dedicated to the analysis of free initiative and respect for property, in the light of social function and sanctions on the economic order. In order to discuss its important aspects, and demonstrate the conductthat does not observe the free initiative and respect for property, and that such violations can culminate in sanctions in the economic order. The methodology used will be the bibliographic review alongside the comparison of the legal rule related to the theme. In order to point out the relevance of alluded to institutes and principles and to raise awareness among social actors not to focus on infractional conduct, which will probably lead to applications of sanctions in the economic order.
