The Democratic Rule of Law, through its regulatory framework, imposes the will of the law, designed to ensure the exercise of social and individual rights, including security, as the supreme values of a fraternal society, founded on social harmony and committed to the peaceful resolution of disputes. When we talk about legal certainty, we are talking about a way of achieving social peace, which is through the authority of res judicata, which makes the content of a decision on the merits immutable and indisputable. This article deals with res judicata in a decision on the merits from the perspective of constitutionality control, as well as the effects of these decisions when made by the Federal Supreme Court.
