an analysis of the third dimension of Fundamental Rights in favor of achieving informational self-determination

This article is about the application of the Third-dimension fundamental rights in order to protect the self-determination of the Information Society. The objective of this article is identify and achieve convergence between the phenomena that gave rise to the current Information Society so that, with the identification of the most relevant third-generation fundamental rights in the digital era, it is possible to stablish a guiding thread that culminates in the achievement of informational self-determination of information technologies’ users. The research problem, therefore, is how relevant are third-dimensional fundamental rights in achieving the informational citizen’s self-determination of citizens in the Information Society? Using bibliographical and documentary research and relying on a qualitative approach, as results, principles such as transparency, auditability, inclusion, education and digital participation are essential pillars for Public Administration and private initiative provide the Information Society´s citizens with decision-making power over the use and development of a new technology, which is essential for collecting and processing data in a responsible, ethical and legal manner.
