O Incidente de Deslocamento de Competência frente ao princípio do juiz natural
Abstract
O Incidente de Deslocamento de Competência - IDC, instituto criado com a Emenda Constitucional nº 45, de 30 de dezembro de 2004, tem por finalidade adequar o funcionamento do Poder Judiciário ao sistema de proteção internacional aos direitos humanos. Nos casos de graves violações a tais direitos, poderá o Procurador-Geral da República suscitar o deslocamento do processo criminal da Justiça Estadual para a Justiça Federal perante o Superior Tribunal de Justiça. A criação foi acompanhada de discussão no plano doutrinário em função de supostas violações ao princípio do juiz natural e do devido processo legal.
