Ativismo judicial: autoritarismo ou mecanismo para a concretude dos direitos constitucionais?
Abstract
Este artigo, que é o início da pesquisa do trabalho de conclusão do curso, tem como objetivo demonstrar que, embora, por definição, o ativismo judicial pareça pejorativo, ele possui alguns aspectos positivos e que podem influenciar sobremaneira tanto o ordenamento jurídico quanto a vida das pessoas, quando analisado sob o enfoque de que é composto pela jurisdição contramajoritária e pela litigância de interesse público.
