Abstract

Este trabalho refere-se à análise da Lei Complementar n.º 135/2010 que, apesar de recente, apresenta bastantes pontos controvertidos, contando com posicionamentos favoráveis e contrários ao seu respeito. Assim, o intuito é abordar, de forma concisa e crítica a norma em apreço, principalmente no que concerne à sua constitucionalidade, bem como as razões que ensejaram a sua edição, buscando demonstrar, ainda, os eventuais efeitos práticos de sua aplicabilidade aliada à sua bagagem histórica.
