The difference between titling and certification of quilombola communities

This study investigated the conceptual, legal, and political distinctions between certification and titling of quilombola territories, focusing on the Remnant Quilombo Community Ilha de São Vicente, located in Araguatins, Tocantins, Brazil. The research aimed to analyze the social, cultural, and territorial impacts resulting from these two legal instruments, as well as to understand the challenges faced by the community in securing their territorial rights. A qualitative approach was adopted, based on a literature review and documentary analysis of institutional, legislative, and community sources. The findings revealed asymmetries between the legal frameworks and the effectiveness of public policy, highlighting delays in titling and bureaucratic obstacles imposed by land agencies. It was also found that, despite the absence of a definitive title, certification by the Fundação Cultural Palmares fostered processes of ethnic-cultural identity strengthening, political mobilization, and autonomous territorial defense strategies by the community.
