Abstract

This study analyzes the combination of procedural business, personality rights and arbitration as instruments to strengthen legal certainty in real estate contracts, avoiding excessive judicialization and promoting effective solutions to contemporary demands. The specific objectives are to address personality rights in real estate contractual relations, arbitration as an alternative for resolving disputes and the convergence between procedural business and arbitration from the perspective of legal certainty. The study adopts the deductive method, the descriptive procedure and the bibliographic research technique. It was found that personality rights, traditionally linked to the extra-patrimonial sphere, play a relevant role in protecting human dignity and in the balance of real estate contractual relations. In this scenario, arbitration presents itself as a fast and effective means of resolving disputes in the real estate sector, allowing greater autonomy to the parties and reducing judicial delays. Therefore, the convergence between procedural business and arbitration reinforces the predictability and stability of contracts, ensuring legal certainty without compromising personality rights. It is concluded that the combination of these instruments represents a significant advance in optimizing conflict resolution in the real estate sector, promoting a business environment based on the principle of legal certainty.
