From Brazil to Europe
analysing the future of cryptoassets in regulatory frameworks

Currency has played a central role in the evolution of societies, adapting to economic and technological transformations. The emergence of Bitcoin and blockchain technology marked a turning point by introducing a decentralized digital monetary system, bringing significant challenges for state regulation. In Brazil, Law No. 14,478/2022 and Decree No. 11,563/2023 represent important regulatory advances; however, they still leave gaps regarding the legal nature of crypto-assets, the delimitation of regulatory competences, the liability of service providers, and the limits of state intervention. In parallel, the European Union seeks to harmonize the sector through the Regulation on Markets in Crypto-Assets (MiCAR). This study adopts as its theoretical framework contemporary debates on the digital economy, regulatory sovereignty, and state intervention, in dialogue with the constitutional foundations of the economic order. A qualitative methodology is employed, using a deductive approach based on bibliographic review and documentary analysis from a comparative legal perspective. The research investigates whether current regulatory models are capable of balancing innovation, consumer protection, and economic sovereignty. It concludes that effective regulation should prioritize transparency and trust without undermining the decentralized nature of the digital economy.
